Del Ponte`s Responsibility Should Be Determined
Horvatic points out how Security Council should determine Carla Del Ponte`s responsibility for inexpertness and misuse of authorities.
President of the Croatian Academy of Legal Sciences Zeljko Horvatic said today how Security Council should not allow the announced departure of the chief prosecutor of the International Criminal Tribunal for Former Yugoslavia Carla Del Ponte from this duty without determining her responsibility for, as he said, inexpertness, misuse of authorities and permanent violation of trust of UN membering countries and world public in international criminal law and jurisdiction.
"Del Ponte is the active destructive part of the international criminal jurisdiction"
Speaking at today`s, third expert-scientific conference "The Hague Tribunal - `mutual criminal undertaking` - what is this?", which gathered famous legal experts in Zagreb, as well as historians, academicians and certain members of the Croatian government from the time of Serbian aggression on Croatia, professor emeritus Zeljko Horvatic pointed out that the chief prosecutor has long since become an active destructive part of the international criminal jurisdiction, because she, as he stressed, has continuously been harming the idea of its actions as a guarantee of supranational justice and righteousness for all states and every member of contemporary humanity.
According to him, "mutual criminal undertaking" was not a part of international common law during the time when the actions from indictments were committed, thus such charges are not in accordance with the principle of legality.
Actions of chief prosecutor and The Hague Tribunal Prosecution, although they are not in accordance with legal principles, as Horvatic points out, are obviously in accordance with the realisation of their role and goals of political and historic "truth" which they are trying to accomplish, he said, with the misuse of the international criminal jurisdiction.
"Shameful part of history"
-If this misuse even partially succeeds and if such "truths" are to be the basis for ICTY`s verdicts, the truth of international criminal jurisdiction and the appliance of international criminal law before the ad hoc Tribunal for Former Yugoslavia will undoubtedly be a shameful part of history of this law in the first decade of the 21st century- he said.
"It is necessary to examine the competence and authority of The Hague Tribunal"
The conference host was former president of the Supreme Court and retired Croatian Constitutional Court judge, Milan Vukovic, read a part of an address by US attorney Eduard Jambrusic, entitling it: "ICTY - secret undertaking of world persons in power".
Jambrusic believes that it is necessary to examine the competence and authority of The Hague tribunal for the sake of protecting Croatian interests.
By bringing up the issue of "aggressor and the victim", he pointed put that placing Slobodan Milosevic and Ante Gotovina on the same defendant`s bench was "tasteless in relation to values of the western civilisation".
Milan Vukovic announced the fourth conference on December 7, 2007 so that it could be discussed which steps are to be taken due to Croatia's pride.
